We aggregate publicly available pricing, availability, and review data from third-party travel providers (including but not limited to Booking.com and Headout) to help users compare and discover tours, activities, and attraction tickets worldwide.

Our services include:

• Searching and browsing tours, activities, and attractions across 150+ countries.
• Comparing prices, ratings, and features from multiple travel providers side-by-side.
• Redirecting you to third-party provider websites to complete bookings.
• Providing editorial content, travel guides, and blog articles.

Important: TourCheckNow does not directly sell, book, or fulfill tours or tickets. All transactions occur exclusively on third-party provider platforms. We are not a party to any transaction between you and a third-party provider.

3. User Eligibility

You must be at least 16 years of age to use the Platform. By using the Platform, you represent and warrant that you meet this age requirement. If you are using the Platform on behalf of an organization, you represent that you have the authority to bind that organization to these Terms.

4. User Conduct

When using the Platform, you agree not to:

• Use the Platform for any unlawful purpose or in violation of any applicable local, national, or international law.
• Attempt to gain unauthorized access to any portion of the Platform, other accounts, or computer systems or networks connected to the Platform.
• Use automated tools, bots, scrapers, or data mining techniques to extract data from the Platform without our prior written consent.
• Interfere with or disrupt the Platform's servers, networks, or infrastructure.

Tour descriptions, images, pricing data, and reviews displayed on the Platform may originate from third-party providers. Such content remains the intellectual property of the respective providers and is displayed under applicable licensing and affiliate agreements.

5.3 Limited License

We grant you a limited, non-exclusive, non-transferable, revocable license to access and use the Platform for personal, non-commercial purposes. This license does not include the right to collect or harvest any data, modify or create derivative works, or use data mining tools on the Platform.

6. Third-Party Links & Services

7. Pricing & Accuracy

While we strive to display accurate and up-to-date pricing information, all prices shown on the Platform are aggregated from third-party sources and may:

• Be subject to change without notice by the respective providers.
• Not include additional taxes, fees, or surcharges that may be applied at checkout.
• Vary based on your location, currency, travel dates, or group size.

8. Disclaimer of Warranties

The Platform and all content, materials, and services provided therein are offered on an "AS IS" and "AS AVAILABLE" basis without any warranties of any kind, either express or implied, including but not limited to:

• Warranties that the Platform will be uninterrupted, error-free, or free from viruses or other harmful components.

9. Limitation of Liability

To the maximum extent permitted by applicable law, TourCheckNow and its directors, employees, agents, and affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to:

Our total aggregate liability to you for all claims arising from or relating to the use of the Platform shall not exceed the amount you paid us (if any) in the twelve (12) months preceding the claim. As we provide a free comparison service, this amount is typically zero.

10. Indemnification

You agree to indemnify, defend, and hold harmless TourCheckNow, its officers, directors, employees, and agents from and against any and all claims, liabilities, damages, losses, or expenses (including reasonable attorney's fees) arising out of or in connection with:

11. Affiliate Disclosures

TourCheckNow participates in affiliate marketing programs. Affiliate relationships do not influence the order or manner in which comparison results are displayed.

12. Termination

We reserve the right to suspend or terminate your access to the Platform at any time, without prior notice or liability, for any reason, including but not limited to a breach of these Terms. Upon termination, your right to use the Platform will immediately cease. All provisions of these Terms that by their nature should survive termination shall survive, including ownership provisions, warranty disclaimers, indemnity, and limitations of liability.

13. Governing Law & Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of the United Arab Emirates, without regard to its conflict of law provisions. Any dispute arising out of or relating to these Terms or your use of the Platform shall be resolved through good-faith negotiations. If the dispute cannot be resolved amicably within 30 days, it shall be submitted to the competent courts of Dubai, UAE.

14. Severability

If any provision of these Terms is found to be unenforceable or invalid by a court of competent jurisdiction, the remaining provisions shall continue in full force and effect.

15. Entire Agreement

These Terms, together with our Privacy Policy and Cookie Policy, constitute the entire agreement between you and TourCheckNow regarding your use of the Platform and supersede any prior agreements.
